Terms & Conditions


1. Only our terms and conditions of delivery and sale are applicable.

By accepting our invoices implicates acceptance of these conditions and they prevail against those of the buyers, unless our written confirmation.

2. Price

Our prices only have an indicating character to which we cannot be committed, unless explicit agreed differently.

3. Deliveries

All delivery periods are approximate and not committing. Late delivery shall never confer a right of dissolution of the contract or in respect of indemnity, interests or non- acceptance of the goods. Any case of force majeure shall result in the suspension of the delivery period and shall not confer any right to the customer in respect of dissolution of the contract or in respect of indemnity. Interruption of the supply of raw materials, strike, lockout and fire shall always be considered to be force majeure.

4. Complaints

Complaints are null and void if they are not made in writing and by registered mail to our address within 8 days of receipt of the goods, or if the merchandise has been subject to any handling. Complaints regarding invoicing are null and void if they are not made in writing and by registered mail to our address within 8 days of receipt of the invoice.

5. Payment

Unless otherwise agreed all invoices are payable in cash nett at our registered address. All other accepted payment methods never can effect any novation, change or cancellation of our general conditions. Incomplete and/or late delivery cannot implicate the non-payment of the delivered goods. In proportion to the delivered goods, partial invoicing is allowed.

Any amount remaining unpaid on the due date shall, automatically and without notice of default, attract interest at a rate 3% above the legal interest rate. If any amount remains wholly or partially unpaid on its due date, and there is no valid reason, the outstanding balance shall be increased by 10%. The amount of this increase shall be not less than 125 EUR and shall not exceed 1.500 EUR, even though an extension of credit may have been agreed and without prejudice to the application of the above-mentioned interest.

6. Property rights

Without prejudice to the buyers’ risks with respect to the goods, the goods sold shall remain our property until full payment has been received by us. In case of non-payment at the due date, the buyer is obliged, at our first request, to return the goods that have not been resold. In such case any advances are acquired by us to cover possible losses at resale.

7. Currency

The invoices must be paid without exception in the currency they were made out.

8. Applicable law – disputes

The present terms are applicable to all our contracts, to the exclusion of possible terms of our buyer. The Belgian law is applicable with the exception of the retention of title clause. For this clause the law of the country of buyer’s domicile is applicable. Disputes arising out of our contracts shall be referred to the Courts of the district of Oudenaarde (Belgium) or, at our discretion, to the Courts at the buyer’s domicile.

9. Right Of Withdrawal

Upon delivery of products:

When purchasing products, the consumer has the ability to dissolve the contract without giving any reason for 14 days. This period commences on the date of receipt of the product by the consumer or designated in advance by the consumer and the entrepreneur announced representative.

During this period the consumer will carefully handle the product and packaging. He will only unpack the product to the extent of use to the extent necessary to assess whether he wishes to keep the product. If he exercises his right of withdrawal, he shall return the product with all accessories and – return in the original condition and packaging to the operator, in accordance with the reasonable and clear instructions provided by the trader – if reasonably possible.

When providing services:

With the delivery of services, the consumer can cancel the contract without giving any reason to dissolve for at least fourteen days, starting on the day of entering into the agreement.

To exercise his right of withdrawal, the consumer focus to the information provided by the operator to supply and / or before the relevant provision reasonable and clear instructions.
